Justice for Captain Saurabh Kalia: The martyr of Kargil War 1999

Captain Saurabh Kalia is one of the martyrs of Kargil War between India and Pakistan in the year 1999. Saurabh Kalia and 5 other soldiers were caught by Pakistan as Prisoners of War and were cruelly tortured and murdered. However, justice has been ignored since last 13 years by the Indian Government and finally, the father of Cpt. Saurabh Kalia has approached the Supreme Court for Justice.

Captain Saurabh Kalia was born on 30th June 1976 at Amritsar and he joined the Indian Army in 1998 after clearing the CDS exam. He was posted in the 4th JAT Regiment (infantry) in Kargil and he was only 22 years old when he sacrificed his life for the nation while guarding the boarders and he was the first one to report Pakistani incursion in the Kargil sector in 1999. Cpt. Kalia and his companions were kept in prison by Pakistan Army for 22 days and the postmortem report reveals that they were brutally tortured and were finally put to death by shooting them in their temples. The Pakistan army tortured the prisoners by burning their bodies with cigarettes, piercing ear-drums with hot rods, pricking eyes before removing them, breaking most of the teeth and bones, fractures of the skull, cutting the lips, cutting of nose, amputation of limbs and private organs of these soldiers, further causing all sorts of physical and mental tortures before shooting them dead and this was proved by the postmortem reports, which stated that these tortures were done before their death.

“Main aisa kaam karunga jisse puri duniya mein mera naam hoga,”

were the last words of capt. Saurabh Kalia (22), 4 JAT Regiment Indian Army, to his mother at the Amritsar Railway Station on December 12, 1998.

The parents of the martyr, Cpt. Saurabh Kalia have been fighting for justice since last 13 years. They have knocked every door for justice, including the President of India and the only thing they received was disappointment. The father wanted that the act of brutality to be declared as a war crime under the Geneva Convention and wanted that Indian Government should exert pressure on Pakistan to apologize, recognize and punish those Pakistani soldiers who were involved in the inhuman act. However, the father of the martyr, Dr. Kalia had collect some information from the Ministry of External Affairs under the Right to Information (RTI) Act, which confirmed the careless approach of Indian government, which said that the then Minister of External Affairs, Jaswant Singh had summoned and gave a notice of breach of the Geneva Convention to the Pakistan High Commission but they completely denied the act of inhumanity. After this, no action was taken by the Government. The only thing that his parents wanted was that the Ministry of External Affairs (MEA) and Ministry of Home Affairs (MHA) should ask International Court of Justice (ICJ) to expose the brutal torture which resulted in his death and declare it as a war crime.

However, his parents have not lost their hope and are still fighting for it and have finally, applied a petition in the Hon’ble Supreme Court for Justice, with the hope that finally their plea will be heard and will direct the Union government to take up the case to the international judicial forum. This was really an act of inhumanity by the Pakistan army and was violation of human rights as well as Geneva Convention. Moreover, no nation has laws that allow torture of their prisoners but the denial of Pakistan Government regarding the act was really a matter of shame. However, it is a matter of disgrace even for our nation that even the President of the largest democracy did not take any step against such act of inhumanity for the ones who have sacrificed their lives just for the sake of safeguarding the lives of several citizens of India. Their sacrifice is immeasurable and the act of Indian Government is really insensible and is completely outrageous. Although the Army Chief said that they have raised concern regarding this issue but does it takes 13 years to raise such an issue? Isn’t this really ridiculous even on the part of Indian Army?

It is now the responsibility of every Indian to support the fight against such act of inhumanity and help the family of the martyr, who has been fighting for justice not only for their son but for every Indian soldier who faces such torture and compel the Government to break their silence and take up the case to the International Court of Justice and declare it as a war crime as well as exert pressure on Pakistan to express regret, recognize and punish those Pakistani soldiers who were involved in the inhuman act. This is not just a fight for an individual but a fight for the soldiers who fight for the safety of the nation and sacrifice their lives for the motherland and it is a fight against injustice against the ones who sacrifices their lives for our safety and security.

  1. The most barbaric and inhuman act by Pakistani troops. My heart goes with the family of slain officer. I pray for them. The Indian government should take up the case to the International Court of Justice and declare it as a war crime as well as exert pressure on Pakistan to help Dr. NK Kalia to get justice.
